TERMS OF USE OF PAISAPYMES.COM 1. PURPOSE paisapymes.com (the "site") is a platform that connects businesses in Medellín and its region (the "businesses") with their customers (the "users"). It offers a directory, catalogues of products and services, and a way to send orders to businesses. The site is operated by DAVELI, sole proprietorship, SIREN 500 068 416, 13 rue de la Curveillère, 81000 Albi, France, contact@daveli.fr (the "operator"). Using the site means accepting these terms. 2. ACCESS Browsing the site and listing a business in the directory are free. No account is needed to place an order. Paid additional services (branding, call center, customer management, consulting, development) may be offered to businesses under a separate agreement. 3. BUSINESS REGISTRATION A business registers through its manager, who declares that they are authorised to represent it. It provides accurate, up-to-date information (company name, NIT, contact details, activity) and keeps it up to date from its space. The operator may check this information before activating the space, and refuse or suspend a registration that is inaccurate or contrary to these terms. Login details are personal; the business is responsible for their use. 4. CONTENT PUBLISHED BY BUSINESSES The business is solely responsible for the content it publishes (texts, prices, images, logos, promotions) and guarantees that it holds the necessary rights. Unlawful, misleading or discriminatory content, content that infringes the rights of others, and the sale of products or services prohibited by law are forbidden. The operator may remove content that does not comply. Prices are shown in Colombian pesos, taxes included where applicable, under the business's responsibility. 5. ORDERS The site sends the user's order to the business concerned; the sale or service contract is made DIRECTLY between the user and the business. The operator is not the seller, does not collect payment and does not guarantee the availability, quality or delivery of products and services. The business confirms the order. Payment is made as agreed with the business (cash on delivery, or a method it offers). The user's consumer rights (information, warranty, withdrawal where provided by law) are exercised with the business. The user receives a summary by email and a personal tracking link; the user should keep this link, which gives access to the order status. 6. PERSONAL DATA Data processed: name, address, neighbourhood, phone numbers, email, content of orders and messages (order, call-back request, contact, chat); for businesses, the registration information. Purposes: sending orders and messages to the businesses concerned, order tracking, answering requests, keeping the site secure. The data of an order is shared with the business it is addressed to; it is not sold or transferred to third parties for commercial purposes. Data controller: DAVELI. Under Colombian Law 1581 of 2012, anyone can access, update and correct their data, request its deletion or withdraw their consent by writing to contact@daveli.fr. Retention period: 2 years after the last order. By sending a form, the user authorises this processing. 7. COOKIES The site uses a session cookie needed for it to work (language, product list, logged-in space). It does not use advertising cookies. 8. LIABILITY The operator takes reasonable measures to keep the site available and secure, without guaranteeing continuous availability. It is not responsible for dealings between users and businesses, nor for content published by businesses. Maps come from OpenStreetMap; locations are indicative. 9. INTELLECTUAL PROPERTY The paisapymes name, logo and site design belong to the operator. The business allows the operator to display its content on the site for as long as it is registered. 10. SUSPENSION AND TERMINATION A business may ask for its space to be closed at any time. The operator may suspend a space in case of breach of these terms, after informing the business except in an emergency. 11. CHANGES TO THE TERMS These terms may change; the version in force is the one published on the site. Registered businesses are informed of significant changes. 12. GOVERNING LAW Colombian law. Failing an amicable settlement, the courts of Medellín have jurisdiction, without prejudice to consumer rights. Version of 28/09/2026.
